CRA responds to the European Commission’s draft Article 102 Guidelines
On 1 August 2024, the European Commission launched a public consultation for comments on its draft guidelines on exclusionary abuses of dominance. The draft guidelines aimed to reflect recent EU courts’ case law on exclusionary abuses, in turn helping to provide greater legal certainty for all relevant stakeholders. CRA Europe helped to provide comments on the draft guidelines, working to help provide further clarity based on prior experience of a wide-range of Article 102 cases in order to benefit all interested parties.
A number of CRA Europe members including Uğur Akgün, Matthew Bennett, Raphaël De Coninck, Dan Donath, Mikaël Hervé, Diana Jackson, Oliver Latham, Matteo Foschi, Sam Marden, Sara Ross, Domilė Butkevičiūtė, Christian Michel, Chara Tzanetaki and Liam Connolly helped to provide comments to the Commission on the draft guidelines.
