Commercial litigation – SFR/Orange second homes
After a Courtroom saga, the Paris Court of Appeal has ruled that Orange abused its dominant position for telephone and Internet access for second homes. Orange must pay damages of €53.4 million to its telecom competitor SFR. The Court of Appeal confirmed that there is a relevant market for second homes access. This decision is based on extensive economic analysis provided by CRA for SFR, using a SSNIP test methodology.
