Car shipping follow-on litigation (UK)
German carmaker Daimler and Norwegian/Swedish shipping company Wallenius Wilhelmsen Logistics and Eukor have reached a settlement, thereby discontinuing the proceedings regarding Daimler’s follow-on claim in front of the UK High Court.
The claim followed the 2018 decision by the European Commission to fine shipping companies 395 million Euros for price fixing in the transport of cars, trucks and other vehicles on sea routes, known as “roll-on, roll-off” or “RoRo” shipping services. According to the Commission Decision, the cartel activity included price coordination, bid rigging, customer allocation and capacity restrictions and involved the shipping companies Kawasaki Kisen Kaisha (“K-Line”), Mitsui OSK Lines (“MOL”), Nippon Yusen Kabushiki Kaisha (“NYK”), Compañía Sudamericana de Vapores (“CSAV”) and Wallenius Wilhelmsen Logistics (“WWL”) – EUKOR.
Raphaël De Coninck acted as an economic expert for WWL and Eukor, who were defendants in this damages litigation by Daimler in front of the UK High Court. The CRA team further included Roman Fischer, Stefano Callari, Christoph von Muellern, Seamus O’Donovan and Simeon Häfele.
